Dwight Scott
ABOUT
Dwight Scott is a founding shareholder of Scott Patton PC. Dwight brings a unique blend of administrative and legal experience to the firm, having over twenty years of combined administrative management and legal experience in the healthcare industry. Before private practice, Dwight worked in-house for a large hospital system where he maintained responsibility for various legal and administrative matters. Immediately prior to forming Scott Patton PC, Dwight worked for a large full-service law firm, where he was elected to the Firm’s Management Committee and headed up the Firm’s Health Care practice.
While Dwight serves many diverse practice areas, he focuses his legal efforts in matters affecting healthcare providers and organizations, including peer review, regulatory and administrative compliance, operations, licensure, risk management, medical malpractice and commercial disputes. He frequently advises clients on federal and state compliance issues, including Stark, Anti-Kickback, EMTALA and HIPAA compliance. Dwight is also a certified mediator. Representation of health care client in arbitration proceedings against large national health insurance carrier regarding improper reimbursements for care to enrolled beneficiaries.
Representation of Medical Executive Committee of large national hospital system in internal peer and quality review investigation including adversarial due process proceedings.
Representation of health care client in an alleged "over billing" investigation by the United States Office of Inspector General.
Representation of a health care client on potential compliance issues involving federal anti-kickback statute, Texas anti-solicitation statute, Stark, False Claims Act, Tax Exemption, Intermediate Sanctions and Provider Based Status Rules.
Representation of a health care client following the theft of 1,100 pages of documents containing protected health information of 2,100 patients including the advisement and counsel on privacy rules and disclosure requirements.
Representation of a health care client in the investigation, coordination and preparation of timely corrective action plans for the Center for Medicare and Medicaid Services (CMS) and Texas Department of State Health Services (TDSHS) for alleged Emergency Medical Treatment and Active Labor Act (EMTALA) violations regarding the treatment and transfer of patients.
Representation of a health care client in the investigation, coordination and preparation of a timely corrective action plan for the Texas Department of Aging and Disability Services (DADS) regarding alleged improper coordination of care of home health and rehabilitation services to pediatric patients.
Representation of national health care company in the investigation, coordination and preparation in a timely corrective action plan for TDSHS' Radiation Control Program regarding citations alleging improper safety monitoring of employees.
Representation of large national health care client in the investigation and coordination of an external investigation regarding a patient care issue involving the United States Food and Drug Administration (FDA), Centers for Disease Control (CDC) and Texas Department of State Health Services (TDSHS).
